Faster Judicial Asset Freezes: What Changes with the New SISBAJUD

The National Council of Justice (CNJ) has implemented new judicial asset-freezing functionalities through the pilot project for the controlled transition to the new Judicial Asset Search System (SISBAJUD) Manual. These changes provide greater speed and effectiveness to bank account freezing orders, requiring immediate strategic attention.

Previously, financial institutions had up to two business days to comply with a court order. Under the new system, the execution time has been drastically reduced to just two hours after the decision is issued. Orders are transmitted by the courts during two daily processing windows, at 1:00 p.m. and 8:00 p.m., allowing for near-immediate freezes.

In addition, judicial orders no longer expire after the first attempt. Through continuous monitoring, an order may remain active for up to one year, automatically freezing new deposits credited to the account until the debt is fully satisfied.

This measure is already in effect for major financial institutions, including Caixa Econômica Federal, Banco do Brasil, Itaú Unibanco, Nubank, and XP Investimentos, with plans to expand it to the entire financial system in the near future.

Key changes:

  • Asset freezes may occur on the same day the court order is issued;
  • Banks will have up to two hours to begin restricting funds;
  • Monitoring may remain in place for up to one year;
  • New deposits may be automatically frozen;
  • The system will operate through two daily processing windows, at 1:00 p.m. and 8:00 p.m.; and
  • Courts and financial institutions will exchange information directly through the system.

The primary objective of this update is to prevent the dissipation of assets and enhance the effectiveness of enforcement proceedings.

In light of this new environment of increased efficiency and automation, rigorous monitoring of all bank accounts and financial transactions becomes essential. The system’s speed requires constant oversight of cash flow, as the ongoing monitoring mechanism may affect operational resources as soon as they are credited to an account. We recommend heightened attention to bank notifications whenever an asset-freezing order is identified, ensuring the prompt adoption of appropriate measures.
