{"id":4512,"date":"2022-03-11T16:18:51","date_gmt":"2022-03-11T19:18:51","guid":{"rendered":"https:\/\/bettamiovivone.websiteseguro.com\/site\/?p=4512"},"modified":"2022-03-11T16:18:51","modified_gmt":"2022-03-11T19:18:51","slug":"voce-sabe-se-a-sua-empresa-se-beneficia-do-reintegra","status":"publish","type":"post","link":"https:\/\/bvp.adv.br\/en\/voce-sabe-se-a-sua-empresa-se-beneficia-do-reintegra\/","title":{"rendered":"Sua empresa se beneficia do Reintegra?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Esse \u00e9 um benef\u00edcio fiscal cedido pelo Governo Federal para as exportadoras que visa \u00e0 devolu\u00e7\u00e3o de parte de valores recolhidos a t\u00edtulo de tributos por empresas. Em s\u00edntese, esse benef\u00edcio objetiva incentivar a produ\u00e7\u00e3o nacional para a exporta\u00e7\u00e3o.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Acontece que, a partir de 2015, o Poder Executivo passou a reduzir os percentuais de restitui\u00e7\u00e3o dos valores previstos no Reintegra da seguinte maneira:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Ano-calend\u00e1rio 2016:<\/strong> de 3% para 1%;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Ano-calend\u00e1rio 2018:<\/strong> de 1% para 0,1%;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Ano-calend\u00e1rio 2019:<\/strong> em diante de 3% para 1%;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nesse cen\u00e1rio, foram ajuizadas a\u00e7\u00f5es judiciais (\u201ca\u00e7\u00f5es direta de inconstitucionalidade\u201d n\u00ba 6.040 e 6.055) perante o Supremo Tribunal Federal (\u201cSTF\u201d). Essas a\u00e7\u00f5es defendem que tais redu\u00e7\u00f5es n\u00e3o poderiam ocorrer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">O STF julgar\u00e1 esse caso no dia 17 de mar\u00e7o sob a sistem\u00e1tica de \u201crepercuss\u00e3o geral\u201d. Isso significa que o que for decidido por aquela Corte Suprema ser\u00e1 aplicado para todos os demais casos semelhantes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Se a empresa recolhe o Reintegra, recomendamos que ingresse com a a\u00e7\u00e3o judicial antes do julgamento para fugir da \u201cmodula\u00e7\u00e3o de efeitos\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Em outras palavras, se a empresa ajuizar a a\u00e7\u00e3o ap\u00f3s o julgamento, correr\u00e1 risco de n\u00e3o conseguir recuperar os valores recolhidos a maior durante os 5 (cinco) anos anteriores ao ajuizamento da a\u00e7\u00e3o.
